i have a 5 years old daughter, in my diverce drecree says that if I wanna change the primary resicende (el paso Tx) I need a letter from the father. but he alredy told me that he wont sing any agreedment. You will need to obtain an attorney to get a decree of the court order on stay of residence.

You cannot just take your daughter outside of the state with out the fathers approval and something in writing and signed with a notary public for short out of state travels. A perminate move of residence would require you have have the court order changed all together stating a new residence and how the visitations rights would be altered -as the father has rights to see his daughter in accordance to the court order. So, if you take her out of state – this may make it harder for him to see her. So, you would need to come to a legal agreement on how visitation rights would be handled in the best interest of the child and the parents abilities.

So, you have to allow your husband to leave the state for his new job and stay behind until a new legal order has been established and signed. I would recommend getting an attorney to see if you can get a temporary court order allowing you to move out of state with your daughter while getting a perminate one established – basically seeing if you can get the judge to sign you a travel order for a certain amount of time – so it;s like your traveling out of state to “visit” your husband during the new court order process – that way you can still leave, but you will have to return for all court dates for the new order and also have to return back to the state with your child – if that order date expires and there is still not a new order established allowing you to live outside of your state the current order is in – if you do not, you will be held in contempt of court and a kidnapping charge placed on you + a warrant for your arrest. YOu do not want that to happen.

So, contact an attorney (check to see if the military can assign you one) and check with your state laws.

One more thing: Court orders are written based on where the child lives – so if you move out of state the new state would take presidence over the child – so, if you can get an order to be allowed to move, you would need to have the new state write the new order based on that states laws. So, it is not an easy or cheap process – especially if the father is going to fight you on the matter.
